1. Definiciones

• "Company", "we", "us", "our": Astralys LLC, a Wyoming limited liability company.
• "Software": The PULSAR Terminal trading utility for MetaTrader 5, including all related files, documentation, updates, patches, and any associated materials.
• "Services": Any hosting, activation, licensing, support, or ancillary services provided by Astralys LLC in connection with the Software.
• "User", "you", "your": Any person or entity who installs, purchases, accesses, or uses the Software or Services.
• "Broker Platform": Third-party trading platforms (e.g., MetaTrader 5 by MetaQuotes) and related services (brokers, data providers, VPS providers, etc.).
• "Marketplace": Third-party distribution platforms such as MQL5 Market through which the Software may be distributed.

2. Aceptación de los Términos

• By installing, downloading, purchasing, or using the Software, you confirm that you are at least 18 years old (or the age of legal majority in your jurisdiction) and have the legal capacity to enter into binding agreements.
• These Terms, together with our Política de Privacidad and Aviso Legal, constitute the entire agreement between you and Astralys LLC regarding the Software.
• We reserve the right to modify these Terms at any time. Continued use of the Software after changes constitutes acceptance of the updated Terms.

3. Naturaleza y Alcance del Software

• The Software is a trading utility / add-on panel designed exclusively for the MetaTrader 5 platform. It provides an interface to facilitate order placement, position management, and trade execution.
• The Software is a tool, not an autonomous trading system. It assists with manual order execution and management. All trading decisions remain entirely yours.
• The Software does not provide investment advice, financial planning, portfolio management, trade signals, or trading recommendations of any kind.
• Astralys LLC is not a broker, investment adviser, or financial institution. We do not hold any financial services license.

4. Concesión de Licencia

• Upon valid purchase, we grant you a non-exclusive, non-transferable, revocable license to use the Software on MetaTrader 5 in accordance with these Terms.
• The license is personal to you. You may not sublicense, rent, lease, lend, sell, redistribute, or transfer the Software or your license to any third party.
• License activation limits (number of accounts or installations) are specified in the product listing on the Marketplace and may vary by plan.

5. Restricciones

Usted acepta NO:

• Reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Software.
• Modify, adapt, translate, or create derivative works based on the Software.
• Remove, alter, or obscure any copyright, trademark, or proprietary notices in the Software.
• Use the Software for any unlawful purpose or in violation of any applicable laws or regulations.
• Share, distribute, or make available your license key or activation credentials to any third party.
• Attempt to bypass, disable, or circumvent any license protection, activation mechanism, or security feature of the Software.
• Use the Software on more accounts or installations than permitted by your license plan.

6. Responsabilidades y Obligaciones del Usuario

Usted reconoce y acepta que:

• Trading decisions: You are solely and entirely responsible for all trading decisions made while using the Software, including the selection of instruments, lot sizes, stop-loss/take-profit levels, risk parameters, and trade timing.
• Platform configuration: You are responsible for correctly configuring and maintaining your MetaTrader 5 platform, including but not limited to broker connection settings, chart settings, and Expert Advisor permissions (AutoTrading enabled, "Allow Algo Trading" enabled).
• VPS & infrastructure: If you use the Software in a live trading environment, you are strongly advised to run MetaTrader 5 on a reliable Virtual Private Server (VPS) with stable internet connectivity. Failure to maintain adequate infrastructure (VPS uptime, power supply, internet connection) may result in missed executions, delayed orders, or unintended positions. Astralys LLC is not responsible for losses arising from infrastructure failures, disconnections, or the decision not to use a VPS.
• Order verification: You are responsible for verifying that all orders placed through the Software are correctly executed on your MetaTrader 5 platform and reflected in your broker account. You must regularly check your open positions, pending orders, and account status. Astralys LLC is not responsible for losses resulting from failure to verify order execution.
• Demo testing: You are strongly advised to test the Software thoroughly on a demo account before using it with real funds. You assume full responsibility for any decision to use the Software on a live account.
• Credentials: You are responsible for safeguarding your MetaTrader account credentials, license keys, and any access credentials. Astralys LLC is not liable for unauthorized use resulting from your failure to secure your credentials.
• Regulatory compliance: You are solely responsible for ensuring that your use of the Software complies with all applicable laws, regulations, and broker/exchange rules in your jurisdiction.

7. Plataformas y Servicios de Terceros

• The Software operates within the MetaTrader 5 platform, which is developed and maintained by MetaQuotes Ltd. Astralys LLC has no control over MetaTrader 5, its updates, behavior, bugs, or availability.
• Your broker is a separate third party. Astralys LLC has no control over and is not responsible for your broker's execution quality, spreads, slippage, requotes, server downtime, order rejection, or any other broker-related issue.
• If the Software is purchased through the MQL5 Market, the transaction and any associated refund policies are governed by MQL5 Market's own terms.
• Astralys LLC is not affiliated with, endorsed by, or sponsored by MetaQuotes Ltd., any broker, or any marketplace platform.

8. Propiedad Intelectual, Antiplagio y Protección de Derechos de Autor

8.1 Propiedad

• The Software, including all source code, object code, algorithms, user interface designs, visual layout, look-and-feel (trade dress), color schemes, button arrangements, panel configurations, workflows, documentation, graphics, logos, icons, and any related materials, is and remains the exclusive intellectual property of Astralys LLC, protected by copyright, trade dress, trademark, and other applicable intellectual property laws.
• The purchase of a license does not transfer any ownership rights in the Software to you. You acquire only the limited right to use the Software as described in these Terms.
• All trademarks, service marks, trade names, and logos displayed in connection with the Software (including but not limited to "PULSAR Terminal", "PULSAR", the PULSAR logo, and associated branding) are the property of Astralys LLC or their respective owners.

8.2 Prohibición de Copia, Clonación y Plagio

Usted acepta expresamente NO:

• Copy, reproduce, clone, or replicate the Software, in whole or in part, in any form or medium.
• Create any product, tool, panel, Expert Advisor, indicator, or script that is substantially similar to the Software in its design, user interface, layout, visual appearance, workflow, feature set, or user experience.
• Use the Software as a reference, template, or basis to develop a competing or derivative product, whether for personal use, commercial distribution, or any other purpose.
• Extract, copy, or imitate the visual design elements, including but not limited to: panel layout, button placement and styling, color schemes, typography, iconography, animations, or overall look-and-feel (trade dress) of the Software.
• Reproduce, redistribute, or repurpose any documentation, tutorials, marketing materials, screenshots, or educational content created by Astralys LLC.
• Use automated tools (scrapers, bots, etc.) to extract design elements, feature descriptions, or any other content from the Software or its associated website.

8.3 Protección de Imagen Comercial

• The overall visual impression of the Software — including its unique combination of panel layout, color palette, typography, button design, feature arrangement, and user interaction patterns — constitutes protectable trade dress under applicable law.
• Any product that creates a likelihood of confusion with, or dilutes the distinctive appearance of, the Software may constitute trade dress infringement and will be subject to legal action.

8.4 DMCA y Reportes de Infracción de Derechos de Autor

• If you become aware of any unauthorized copy, clone, or substantially similar product that infringes on the intellectual property of Astralys LLC, please report it to us immediately at contact@pulsar-technologies.io.
• Astralys LLC reserves the right to file DMCA takedown notices with any platform, marketplace (including MQL5 Market), hosting provider, or service where infringing content is found.
• Astralys LLC reserves the right to pursue all available legal remedies against any person or entity that infringes its intellectual property, including but not limited to: injunctive relief, actual damages, statutory damages, disgorgement of profits, and attorneys' fees.

8.5 Monitoreo y Cumplimiento

• Astralys LLC actively monitors marketplaces, forums, and distribution channels for unauthorized copies or clones of the Software.
• We may use technical measures, watermarking, or code fingerprinting to identify unauthorized reproductions.
• Any license obtained by a user found to be involved in intellectual property infringement will be immediately and permanently revoked without refund.

9. Actualizaciones de Software, Corrección de Errores y Soporte

• Astralys LLC is committed to continuously improving the Software. We actively listen to community feedback and strive to release updates and bug fixes in a timely manner.
• However, no software is free from defects. Despite our best efforts and due diligence, bugs, errors, or unexpected behavior may occur. The Software is provided "as is" with respect to any undiscovered defects.
• Astralys LLC shall not be held liable for any losses, damages, or adverse consequences arising from software bugs, errors, latency, crashes, or unexpected behavior, whether known or unknown at the time of occurrence.
• Updates may be released at our discretion. We are not obligated to provide updates, new features, or indefinite support, although we intend to do so as part of our commitment to users.
• You are responsible for keeping your Software up to date. Running an outdated version may expose you to known issues that have been resolved in newer releases.

10. Descargo de Garantía

• We do not warrant that the Software will be error-free, uninterrupted, secure, or free of viruses or harmful components.
• We do not warrant that the Software will meet your specific requirements or expectations, or that it will produce any particular trading results.
• We do not warrant the accuracy, completeness, or reliability of any information displayed by the Software.
• Any reliance on the Software is at your sole risk.

11. Limitación de Responsabilidad

• Our total aggregate liability to you for all claims arising from or relating to these Terms or the Software shall not exceed the amount you actually paid to Astralys LLC for the Software in the twelve (12) months preceding the claim.
• This limitation applies regardless of whether we have been advised of the possibility of such damages and regardless of whether any remedy fails of its essential purpose.
• Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.

12. Indemnización

You agree to indemnify, defend, and hold harmless Astralys LLC and its officers, directors, employees, agents, affiliates, successors, and assigns from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use or misuse of the Software; (b) your trading activities or decisions; (c) your violation of these Terms; (d) your violation of any applicable laws, regulations, or third-party rights; or (e) any negligent or wrongful conduct by you.

13. Pago y Reembolsos

• The Software is available for purchase through the MQL5 Market or other authorized distribution channels. Pricing is specified on the product listing page.
• All payments are processed by the respective Marketplace platform. Astralys LLC does not directly process credit card or bank payments.
• Refund policies are governed by the terms of the Marketplace through which you purchased the Software. Please refer to MQL5 Market's refund policy or the relevant platform's terms.
• A free demo version is available for testing. We strongly encourage testing the demo before purchasing.

14. Terminación

• We may suspend or terminate your license at any time if you violate these Terms, without prior notice and without liability.
• Upon termination, your right to use the Software ceases immediately. You must delete all copies of the Software in your possession.
• Sections that by their nature should survive termination (including Warranty Disclaimer, Limitation of Liability, Indemnification, and Governing Law) shall survive.

15. Fuerza Mayor

Astralys LLC shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to: natural disasters, acts of war or terrorism, pandemics, government actions, power or internet outages, broker or exchange outages, MetaTrader platform failures, cyberattacks, or any other force majeure event.

16. Divisibilidad

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions, which shall continue in full force and effect.

17. Ley Aplicable y Resolución de Disputas

• These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States of America, without regard to its conflict of law provisions.
• Any disputes arising out of or relating to these Terms or the Software shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration administered in accordance with the rules of the American Arbitration Association (AAA), with the arbitration seated in Wyoming, USA.
• You waive any right to participate in a class action lawsuit or class-wide arbitration against Astralys LLC.

18. Acuerdo Completo

These Terms of Service, together with the Política de Privacidad and Aviso Legal, constitute the entire agreement between you and Astralys LLC with respect to the Software and supersede all prior or contemporaneous agreements, representations, warranties, and understandings.
